Terms of Service & User Agreement

PLEASE READ THIS TERMS OF SERVICE & USER AGREEMENT (“Agreement”) CAREFULLY.

This Agreement is entered into between:

(“RMG News Academy,” “Company,” “we,” “our,” or “us”)

and the individual accessing, purchasing, enrolling in, or using the Services (“User,” “you,” or “your”).

This Agreement governs all use of:

  • websites;
  • landing pages;
  • online courses;
  • memberships;
  • coaching;
  • webinars;
  • livestreams;
  • communities;
  • educational materials;
  • downloads;
  • templates;
  • newsletters;
  • digital products;
  • videos;
  • proprietary systems;
  • future offerings;
  • related services

(collectively, the “Services”).

By accessing, purchasing, enrolling in, or using the Services, you:

ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE LEGALLY BOUND BY THIS AGREEMENT.

If you do not agree:

These provisions materially affect your legal rights.

By accessing or using the Services, you voluntarily agree to these terms.

3. AGE REQUIREMENT & ELIGIBILITY

By accessing, purchasing, enrolling in, or using the Services, you represent and warrant that:

YOU ARE AT LEAST EIGHTEEN (18) YEARS OLD

and legally capable of entering into a binding agreement.

The Services are intended solely for:

ADULTS AGED EIGHTEEN (18) YEARS OR OLDER.

If you are under the age of:

EIGHTEEN (18),

you may not:

  • purchase Services;
  • enroll in courses;
  • access educational materials;
  • participate in memberships;
  • access communities;
  • participate in coaching;
  • use the Services.

By purchasing any Service, you affirm and warrant that:

  • you are at least eighteen (18) years old;
  • information provided during purchase is accurate;
  • you possess legal authority to enter into binding agreements;
  • you are not prohibited from entering into contracts under applicable law.

RMG News Academy reserves the right to:

  • refuse service;
  • suspend accounts;
  • restrict access;
  • terminate access;
  • revoke purchases

if we reasonably believe a user does not satisfy eligibility requirements.

Misrepresentation of age may result in:

IMMEDIATE TERMINATION OF ACCESS, EXCEPT WHERE REQUIRED BY APPLICABLE LAW.

3A. SANCTIONS & RESTRICTED PERSONS

You represent and warrant that you are not:

  • located in, ordinarily resident in, or accessing the Services from any country or territory subject to comprehensive economic or trade sanctions administered by the United States government;
  • identified on any United States government restricted-party list, including the Specially Designated Nationals and Blocked Persons List (SDN List); or
  • otherwise prohibited from receiving the Services under applicable United States export control or sanctions laws.

RMG News Academy reserves the right to suspend, restrict, deny, or terminate access to the Services where necessary to comply with applicable laws, regulations, governmental sanctions programs, export control requirements, or legal obligations.

Nothing in the Services shall be interpreted as authorizing access where such access would violate applicable laws or regulations. Users remain solely responsible for ensuring that their access to and use of the Services complies with all laws applicable to their location and circumstances.

4. EDUCATIONAL PURPOSES ONLY

The Services are provided solely for:

EDUCATIONAL AND INFORMATIONAL PURPOSES.

Nothing within the Services constitutes:

  • legal advice;
  • journalism legal advice;
  • FAA or aviation instruction;
  • financial advice;
  • investment advice;
  • tax advice;
  • accounting advice;
  • employment guarantees;
  • licensing guarantees;
  • publishing guarantees;
  • emergency responder training.

Nothing in the Services should be interpreted as:

PROFESSIONAL OR LEGAL GUIDANCE.

You remain solely responsible for:

  • decisions;
  • journalism conduct;
  • filming decisions;
  • publishing decisions;
  • business actions;
  • legal compliance;
  • safety decisions.

You should consult qualified professionals where appropriate.

5. GUEST INTERVIEWS, THIRD-PARTY CONTENT & EXTERNAL RESOURCES

Certain Services may include recorded interviews, appearances, commentary, or educational contributions from third-party professionals, including but not limited to:

  • assignment desk managers;
  • law enforcement Public Information Officers (PIOs);
  • attorneys;
  • producers;
  • journalists;
  • media professionals;
  • emergency response personnel;
  • subject matter experts;
  • other guests or contributors.

Such content (“Guest Content”) is provided solely for:

EDUCATIONAL AND INFORMATIONAL PURPOSES.

The views, opinions, recommendations, commentary, and statements expressed by guests are:

THEIR OWN

and do not necessarily reflect the views, opinions, policies, or positions of:

RAISHBROOK MEDIA GROUP, LLC d/b/a RMG NEWS ACADEMY OR HOWARD RAISHBROOK.

RMG News Academy does not guarantee, warrant, or represent the:

  • completeness;
  • accuracy;
  • legality;
  • timeliness;
  • reliability; or
  • applicability

of Guest Content.

Nothing stated by any guest shall constitute:

  • legal advice;
  • journalism legal advice;
  • business advice;
  • financial advice;
  • tax advice;
  • employment advice;
  • licensing guarantees;
  • publication guarantees; or
  • professional guidance.

Where guests discuss products, software, tools, services, media organizations, agencies, workflows, or vendors, such discussion does not constitute:

AN ENDORSEMENT BY RMG NEWS ACADEMY

unless expressly stated.

Guest Content may include references or links to third-party websites, products, software, services, tools, or platforms. RMG News Academy is not responsible for:

  • third-party content;
  • third-party accuracy;
  • website availability;
  • pricing;
  • services;
  • policy changes; or
  • actions of third parties.

Use of any third-party service remains solely at your own discretion and risk.

All Guest Content remains protected by:

COPYRIGHT, LICENSE, AND INTELLECTUAL PROPERTY LAW.

You may not reproduce, redistribute, share, republish, upload, record, or commercially exploit Guest Content outside the Services without prior written permission.

6. NO GUARANTEE OF RESULTS

RMG News Academy makes:

NO GUARANTEES

regarding:

  • income;
  • earnings;
  • footage sales;
  • licensing revenue;
  • station relationships;
  • assignment desk relationships;
  • YouTube growth;
  • subscribers;
  • monetization;
  • sponsorships;
  • employment;
  • media opportunities;
  • audience growth;
  • business success.

Results vary substantially between individuals.

Past performance does not guarantee future results.

Any examples involving:

Howard Raishbrook, RMG News, students, guests, or third parties

are:

INDIVIDUAL EXAMPLES ONLY

and shall not be interpreted as guarantees of future success.

7. THIRD-PARTY PRODUCTS, TOOLS & RECOMMENDATIONS

RMG News Academy may discuss, reference, demonstrate, recommend, or provide educational commentary regarding third-party products, software, services, tools, equipment, platforms, subscriptions, applications, or vendors, including but not limited to:

  • cameras;
  • lenses;
  • drones;
  • scanners;
  • radios;
  • editing software;
  • media tools;
  • vehicles;
  • communications equipment;
  • applications;
  • insurance providers;
  • business services; and
  • journalism-related products.

Our recommendations are based upon:

  • professional experience;
  • real-world field use;
  • independent evaluation;
  • industry knowledge; and/or
  • genuine belief in the usefulness of a product or service.

Where affiliate relationships exist, RMG News Academy may receive compensation from purchases made through referral links or affiliate arrangements.

However:

THE EXISTENCE OF AN AFFILIATE RELATIONSHIP DOES NOT DETERMINE WHICH PRODUCTS WE RECOMMEND.

We aim to recommend only products, services, and tools we believe may be useful to students.

Nothing within the Services constitutes:

  • a guarantee of suitability;
  • a guarantee of performance;
  • a guarantee of business success;
  • purchasing advice; or
  • a guarantee of outcomes.

You remain solely responsible for evaluating whether any recommended product, tool, or service is appropriate for your needs, experience level, budget, legal obligations, or intended use.

8. HIGH-RISK ACTIVITY ACKNOWLEDGMENT

You acknowledge that journalism, breaking news gathering, filming, photography, videography, travel, drone operation, scanner monitoring, and emergency scene attendance may involve inherently dangerous activities and risks.

A full description of risks, your formal assumption of those risks, and the scope of your waiver are set forth in:

SECTION 29 (ASSUMPTION OF RISK)

which you have read and agreed to.

No story is worth:

INJURY, DEATH, OR HARM TO OTHERS.

9. SAFETY & LEGAL COMPLIANCE

RMG News Academy does not encourage or authorize:

  • speeding;
  • reckless driving;
  • unlawful scene entry;
  • trespassing;
  • violating police lines;
  • violating fire perimeters;
  • violating evacuation zones;
  • unlawful recording;
  • illegal drone use;
  • responder interference.

You remain solely responsible for complying with:

  • federal law;
  • state law;
  • local law;
  • privacy laws;
  • drone regulations;
  • traffic laws;
  • trespass laws;
  • recording consent laws;
  • responder instructions.

Nothing in the Services authorizes unlawful conduct.

10. PRESS ACCESS DISCLAIMER

Completion of any Service does NOT guarantee:

  • press credentials;
  • police access;
  • fire department access;
  • emergency access;
  • preferred positioning;
  • interviews;
  • station cooperation;
  • media recognition.

Press credentials do not override:

  • police perimeters;
  • crime scene restrictions;
  • evacuation zones;
  • trespass laws;
  • private property rights;
  • lawful responder orders.

You agree to comply with lawful instructions from:

  • police officers;
  • firefighters;
  • EMTs;
  • public officials;
  • security personnel;
  • property owners.

11. ACCOUNT REGISTRATION & SECURITY

Certain Services may require account creation.

You agree to:

  • provide accurate information;
  • maintain updated information;
  • maintain account confidentiality;
  • protect passwords;
  • notify us of unauthorized access.

You are responsible for activity occurring under your account.

You may not:

  • share accounts;
  • share passwords;
  • share credentials;
  • permit simultaneous users;
  • allow unauthorized access.

Violations may result in:

IMMEDIATE SUSPENSION OR TERMINATION,

except where required by applicable law.

12. LIMITED LICENSE GRANT

Subject to compliance with this Agreement, you receive a:

LIMITED, REVOCABLE, NON-EXCLUSIVE, NON-TRANSFERABLE, NON-SUBLICENSEABLE LICENSE

for:

PERSONAL INDIVIDUAL EDUCATIONAL USE ONLY.

The Services are:

LICENSED — NOT SOLD.

No ownership rights are transferred.

Access may be revoked for violations of this Agreement.

13. INTELLECTUAL PROPERTY OWNERSHIP

All Services and materials remain the exclusive property of:

RAISHBROOK MEDIA GROUP, LLC

d/b/a RMG News Academy

or its licensors.

Protected materials include but are not limited to:

  • videos;
  • downloads;
  • templates;
  • PDFs;
  • frameworks;
  • scanner methods;
  • journalism systems;
  • licensing systems;
  • pricing systems;
  • outreach systems;
  • educational methodologies;
  • branding;
  • graphics;
  • logos;
  • trademarks.

Licensed third-party content includes but is not limited to:

  • guest interviews;
  • recorded professional interviews;
  • expert commentary;
  • bonus interviews;
  • supplemental educational recordings.

Such content may be licensed to RMG News Academy and remains protected against unauthorized redistribution, copying, recording, or reuse.

All rights are reserved.

Unauthorized use is prohibited.

14. PROHIBITED USES

You may not:

  • copy materials;
  • reproduce lessons;
  • screen record content;
  • pirate content;
  • redistribute materials;
  • upload content;
  • repost materials;
  • share through Google Drive;
  • share through Dropbox;
  • share through Telegram;
  • share through Discord;
  • resell content;
  • train others using proprietary systems;
  • provide newsroom access;
  • upload materials into AI systems.

Unauthorized use may result in:

  • termination;
  • legal enforcement;
  • injunctive relief;
  • damages claims;

account suspension.

15. NEWSROOM, TEAM & ENTERPRISE RESTRICTIONS

The license granted under this Agreement is:

INDIVIDUAL ONLY.

Unless expressly authorized in writing by RMG News Academy, one purchase may NOT be used to:

  • train newsroom staff;
  • train employees;
  • train contractors;
  • train agencies;
  • train teams;
  • train stations;
  • train production companies;
  • train organizations;
  • train educational institutions.

Separate:

ENTERPRISE LICENSING

is required for:

  • broadcasters;
  • newsrooms;
  • stations;
  • media companies;
  • universities;
  • schools;
  • agencies;
  • organizations;
  • businesses.

Unauthorized organizational or business use constitutes:

A MATERIAL BREACH OF THIS AGREEMENT.

16. COMPETITIVE USE RESTRICTION (3 YEARS)

You agree that for a period of:

THREE (3) YEARS

following purchase of any Service, you shall not use:

RMG NEWS ACADEMY PROPRIETARY MATERIALS, CONFIDENTIAL METHODS, OR PROTECTED EDUCATIONAL CONTENT

to:

  • create substantially similar journalism education programs;
  • create substantially similar breaking news training programs;
  • reproduce proprietary educational systems;
  • commercially exploit proprietary methodologies;
  • teach confidential educational systems substantially derived from RMG proprietary content;
  • create derivative educational products substantially based upon RMG proprietary systems.

For clarity:

THIS RESTRICTION APPLIES ONLY TO PROPRIETARY MATERIALS, CONFIDENTIAL METHODS, AND PROTECTED EDUCATIONAL CONTENT.

Nothing in this Agreement restricts:

  • lawful competition;
  • independent journalism education;
  • independent experience;
  • independently developed methods;
  • general industry knowledge;
  • lawful professional activities.

17. CONFIDENTIAL & PROPRIETARY INFORMATION

You acknowledge that the Services may contain:

CONFIDENTIAL, PROPRIETARY, AND TRADE SECRET INFORMATION

including but not limited to:

  • scanner workflows;
  • licensing systems;
  • station outreach methods;
  • journalism strategies;
  • monetization systems;
  • pricing methodologies;
  • assignment methods;
  • operational workflows;
  • business systems;
  • educational frameworks.

You agree not to:

  • disclose;
  • publish;
  • redistribute;
  • reproduce;
  • teach;
  • commercially exploit;
  • share

confidential methods learned through the Services without prior written authorization.

These obligations survive termination.

18. PAYMENTS

You agree to pay all fees associated with purchases made through the Services.

You authorize RMG News Academy and its third-party payment processors to charge:

  • credit cards;
  • debit cards;
  • installment plans;
  • recurring subscriptions;
  • payment accounts.

You agree to provide:

  • accurate billing information;
  • valid payment methods;
  • updated payment information.

Failure to make payment may result in:

  • suspended access;
  • restricted access;
  • revoked benefits;
  • collections efforts;
  • legal enforcement.

19. PAYMENT PLANS

If payment plans are offered:

You agree to complete:

ALL SCHEDULED PAYMENTS.

Payment plans are:

NOT SUBSCRIPTIONS

unless expressly stated otherwise.

Failure to complete installment payments does not:

  • void obligations;
  • eliminate balances owed;
  • terminate this Agreement.

RMG News Academy may:

  • retry payments;
  • suspend access;
  • revoke bonuses;
  • restrict Services;
  • pursue lawful collection efforts.

You remain responsible for unpaid balances.

20. SUBSCRIPTIONS & MEMBERSHIPS

If memberships, subscriptions, coaching communities, or recurring Services are offered now or in the future:

You authorize:

RECURRING BILLING

until cancellation.

Unless otherwise stated:

  • subscriptions renew automatically;
  • cancellation stops future renewals only;
  • no prorated refunds apply;
  • unused Services do not create refund rights.

Forgotten cancellations do not create refund eligibility, except where required by applicable law.

21. REFUND POLICY

Refunds are governed exclusively by the:

which is incorporated into this Agreement by reference.

Refund eligibility requires that you have accessed less than twenty-five percent (25%) of the applicable course or program content within fourteen (14) days of purchase. Full terms are set out in the Refund & Billing Policy.

Because Services may include:

  • digital educational content;
  • immediate access materials;
  • proprietary systems;
  • downloadable content;
  • memberships;
  • digital access;

certain purchases may become:

NON-REFUNDABLE

after access begins,

except where required by applicable law.

22. DIGITAL CONTENT WAIVER (EU / UK / INTERNATIONAL USERS)

Where permitted by law, by purchasing digital educational content and requesting immediate access, you expressly:

CONSENT TO IMMEDIATE PERFORMANCE

and acknowledge that:

CERTAIN STATUTORY CANCELLATION RIGHTS MAY BE WAIVED

once access begins.

This provision applies particularly to:

  • European Union residents;
  • United Kingdom residents;
  • jurisdictions recognizing digital cooling-off periods;

to the fullest extent permitted by law.

23. CHARGEBACKS & PAYMENT DISPUTES

Before initiating any:

  • chargeback;
  • billing dispute;
  • payment reversal;
  • payment processor complaint;

you agree to first contact:

to seek good-faith resolution.

Improper, abusive, fraudulent, or bad-faith chargebacks may result in:

  • account suspension;
  • permanent revocation of access;
  • collections activity;
  • denial of future purchases;
  • legal enforcement.

To defend payment disputes, RMG News Academy may provide payment processors with:

  • purchase records;
  • login history;
  • IP logs;
  • watch history;
  • access records;
  • completion percentages;
  • download activity;
  • acceptance records;
  • account activity.

24. ANTI-PIRACY POLICY

Unauthorized copying, redistribution, uploading, downloading, reposting, account sharing, screen recording, or piracy is strictly prohibited.

This includes but is not limited to:

  • Telegram sharing;
  • Discord sharing;
  • Google Drive sharing;
  • Dropbox sharing;
  • cloud redistribution;
  • torrent websites;
  • reposted uploads;
  • unauthorized training.

We actively monitor and protect our intellectual property.

Violations may result in:

  • immediate suspension;
  • permanent revocation of access;
  • DMCA takedowns;
  • injunctive relief;
  • legal claims;
  • damages.

24A. DMCA DESIGNATED AGENT

Pursuant to 17 U.S.C. §512(c)(2), RMG News Academy\’s designated agent to receive notifications of claimed copyright infringement is:

To be effective, infringement notices must comply with the requirements of 17 U.S.C. §512(c)(3) and should be submitted in writing to the address or email above.

25. LIQUIDATED DAMAGES

You acknowledge that unauthorized redistribution, piracy, account sharing, unauthorized training, commercial misuse, or unlawful exploitation of the Services may result in:

SUBSTANTIAL DAMAGES THAT ARE DIFFICULT TO CALCULATE PRECISELY.

Accordingly, RMG News Academy may seek:

LIQUIDATED DAMAGES OF UP TO \$5,000 USD PER VIOLATION

representing a reasonable pre-estimate of:

  • lost licensing value;
  • lost revenue;
  • diminished course value;
  • investigative costs;
  • enforcement costs;
  • administrative costs;
  • reputational harm;
  • legal exposure.

or:

ACTUAL DAMAGES, IF GREATER.

This provision is intended as a:

REASONABLE ESTIMATE OF DAMAGES

and not a penalty.

RMG News Academy reserves the right to seek:

  • injunctive relief;
  • equitable remedies;
  • attorneys[‘]{dir=”rtl”} fees where permitted by law;
  • additional lawful damages.

26. COMMUNITY CONDUCT

If communities, memberships, coaching groups, webinars, or student groups are offered:

You agree not to:

  • harass others;
  • bully others;
  • threaten others;
  • discriminate;
  • dox members;
  • encourage unsafe journalism;
  • encourage unlawful activity;
  • encourage reckless driving;
  • interfere with responders;
  • encourage trespassing;
  • pirate materials;
  • solicit competing services;
  • disclose confidential information.

Participation is:

A PRIVILEGE — NOT A RIGHT.

RMG News Academy reserves the right to suspend or remove access for misconduct:

EXCEPT WHERE REQUIRED BY APPLICABLE LAW.

27. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

THE SERVICES ARE PROVIDED:

“AS IS” AND “AS AVAILABLE.”

RMG News Academy disclaims all warranties, express or implied, including:

  • merchantability;
  • fitness for a particular purpose;
  • uninterrupted access;
  • compatibility;
  • reliability;
  • performance;
  • availability;
  • business outcomes.

We make no guarantees regarding:

  • earnings;
  • footage sales;
  • licensing success;
  • monetization;
  • station relationships;
  • uninterrupted access.

28. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

RAISHBROOK MEDIA GROUP, LLC D/B/A RMG NEWS ACADEMY, ITS OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, INSTRUCTORS, SUCCESSORS, ASSIGNS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR:

  • indirect damages;
  • incidental damages;
  • consequential damages;
  • punitive damages;
  • business interruption;
  • lost profits;
  • lost revenue;
  • licensing losses;
  • monetization failures;
  • injuries;
  • emotional distress;
  • reputational harm;
  • legal claims;
  • equipment damage.

TO THE FULLEST EXTENT PERMITTED BY LAW:

OUR TOTAL AGGREGATE LIABILITY

shall not exceed:

THE TOTAL AMOUNT ACTUALLY PAID BY YOU

for the applicable Service giving rise to the claim during the preceding:

TWELVE (12) MONTHS.

29. ASSUMPTION OF RISK

You acknowledge that journalism, breaking news gathering, filming, photography, videography, travel, drone operation, scanner monitoring, emergency scene attendance, and related activities may involve:

INHERENTLY DANGEROUS RISKS.

Potential risks include but are not limited to:

  • bodily injury;
  • permanent disability;
  • death;
  • robbery;
  • assault;
  • unstable individuals;
  • crime scenes;
  • riots;
  • protests;
  • fires;
  • crashes;
  • severe weather;
  • smoke exposure;
  • hazardous materials;
  • dangerous environments;
  • emotional distress;
  • legal consequences;
  • business losses.

You further acknowledge that:

EMERGENCY SCENES ARE DYNAMIC, DANGEROUS, AND INHERENTLY UNPREDICTABLE.

Conditions may rapidly change without warning and may involve hazards not immediately visible or foreseeable.

You further acknowledge that certain educational materials may include:

GRAPHIC, DISTRESSING, OR EMOTIONALLY CHALLENGING REAL-WORLD JOURNALISM CONTENT

including but not limited to:

  • fatal crashes;
  • serious injuries;
  • fires;
  • violence;
  • traumatic emergency scenes;
  • emergency audio;
  • disturbing footage.

Viewer discretion is advised.

You knowingly and voluntarily:

ASSUME ALL RISKS

associated with:

  • attending scenes;
  • filming;
  • publishing;
  • journalism activities;
  • travel;
  • business decisions;
  • licensing activities;
  • use of information obtained through the Services.

Nothing in the Services encourages:

  • reckless conduct;
  • unlawful activity;
  • trespassing;
  • responder interference;
  • dangerous driving;
  • illegal drone operation.

No story is worth:

INJURY, DEATH, OR HARM TO OTHERS.

30. RELEASE OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

You release, waive, discharge, and hold harmless:

d/b/a RMG News Academy

and its:

  • owners;
  • officers;
  • employees;
  • contractors;

  • journalism activities;
  • field reporting;
  • filming;
  • publishing;
  • licensing;
  • scanner use;
  • drone use;
  • travel;
  • emergency scene attendance;
  • driving;
  • business decisions;
  • educational reliance;
  • participation in the Services.

This release includes claims arising from:

NEGLIGENCE

to the fullest extent permitted by law.

except where prohibited by applicable law.

31. INDEMNIFICATION

You agree to:

DEFEND, INDEMNIFY, AND HOLD HARMLESS

Raishbrook Media Group, LLC d/b/a RMG News Academy and its:

  • owners;
  • employees;
  • contractors;
  • instructors;
  • affiliates;
  • licensors;
  • representatives;
  • successors;
  • assigns

from and against any:

  • claims;
  • lawsuits;
  • liabilities;
  • investigations;
  • penalties;
  • settlements;
  • judgments;
  • losses;
  • damages;
  • attorneys[‘]{dir=”rtl”} fees;
  • costs

arising out of or relating to:

  • your conduct;
  • journalism activities;
  • filming;
  • publishing;
  • trespass claims;
  • privacy claims;
  • copyright claims;
  • defamation claims;
  • drone use;
  • scanner use;
  • unsafe conduct;
  • unlawful conduct;
  • account misuse;
  • payment disputes;
  • chargebacks;
  • violation of this Agreement.

This obligation survives termination.

32. THIRD-PARTY SERVICES & TECHNOLOGY

The Services may reference, integrate with, or rely upon third-party providers including but not limited to:

  • YouTube;
  • Meta;
  • Facebook;
  • Instagram;
  • X;
  • TikTok;
  • Google;
  • WordPress;
  • webinar providers;
  • payment processors;
  • AI systems;
  • analytics providers;
  • email providers;
  • hosting providers.

RMG News Academy does not control third-party platforms and shall not be responsible for:

  • outages;
  • downtime;
  • pricing changes;
  • account restrictions;
  • policy changes;
  • demonetization;
  • discontinued services;
  • technical failures;
  • feature removals.

Use of third-party platforms is governed by:

THEIR OWN TERMS AND POLICIES.

33. FORCE MAJEURE

RMG News Academy shall not be liable for delays, failures, interruptions, or inability to perform resulting from circumstances beyond reasonable control.

This includes but is not limited to:

  • wildfire;
  • earthquake;
  • severe weather;
  • flood;
  • pandemic;
  • epidemic;
  • cyberattack;
  • ransomware;
  • hosting failures;
  • internet outages;
  • power failures;
  • labor shortages;
  • civil unrest;
  • riots;
  • terrorism;
  • war;
  • governmental actions;
  • legal restrictions;
  • payment processor disruptions;
  • acts of God.

Performance obligations may be:

DELAYED, SUSPENDED, MODIFIED, OR CANCELLED

without liability.

34. TERMINATION & ACCESS REVOCATION

RMG News Academy reserves the right to:

IMMEDIATELY SUSPEND, RESTRICT, REVOKE, OR TERMINATE ACCESS

for reasons including but not limited to:

  • piracy;
  • account sharing;
  • payment abuse;
  • fraud;
  • harassment;
  • unsafe conduct;
  • unlawful conduct;
  • responder interference;
  • community violations;
  • confidentiality breaches;
  • competitive misuse;
  • misuse of Services;
  • reputational harm.

Termination does not eliminate:

  • payment obligations;
  • legal liability;
  • confidentiality obligations;
  • intellectual property obligations;
  • survival clauses.

No refunds shall be owed:

EXCEPT WHERE REQUIRED BY APPLICABLE LAW.

35. INFORMAL DISPUTE RESOLUTION

Before initiating arbitration or legal proceedings, you agree to first contact:

  • description of dispute;
  • proposed resolution.

The parties agree to attempt good-faith resolution for:

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

ALL DISPUTES ARISING OUT OF OR RELATING TO:

  • this Agreement;
  • purchases;
  • refunds;
  • coaching;
  • memberships;
  • content;
  • billing;
  • advertising;
  • privacy;
  • communities;
  • educational materials;
  • Services

shall be resolved exclusively through:

FINAL, CONFIDENTIAL, INDIVIDUAL, BINDING ARBITRATION

LOS ANGELES COUNTY, CALIFORNIA

The arbitration shall be administered by:

THE AMERICAN ARBITRATION ASSOCIATION (“AAA”)

under applicable:

AAA CONSUMER ARBITRATION RULES.

Arbitration shall:

  • occur in English;
  • use a single arbitrator;
  • remain confidential;
  • prohibit class proceedings.

ARBITRATION FEES

shall be allocated consistent with:

APPLICABLE AAA CONSUMER RULES.

Where required by law or AAA rules, RMG News Academy shall pay consumer arbitration fees as required.

Nothing herein is intended to limit:

NON-WAIVABLE CONSUMER RIGHTS.

Judgment on any arbitration award may be entered in any court of competent jurisdiction.

37. CLASS ACTION WAIVER

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

You agree to resolve disputes only on an:

INDIVIDUAL BASIS.

You waive any right to participate in:

  • class actions;
  • collective actions;
  • representative actions;
  • consolidated actions;
  • class arbitration.

No arbitrator may combine claims.

38. JURY TRIAL WAIVER

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

You knowingly and voluntarily waive:

ANY RIGHT TO A JURY TRIAL.

39. SMALL CLAIMS & INJUNCTIVE RELIEF

Either party may pursue qualifying disputes in:

where eligible.

RMG News Academy may seek immediate:

INJUNCTIVE RELIEF

for:

  • piracy;
  • copyright infringement;
  • intellectual property theft;
  • confidentiality breaches;
  • account sharing;
  • unauthorized use.

You consent to exclusive jurisdiction in:

LOS ANGELES COUNTY, CALIFORNIA

for injunctive relief proceedings.

40. GOVERNING LAW

This Agreement shall be governed exclusively by:

THE LAWS OF THE STATE OF CALIFORNIA

without regard to conflict-of-law principles.

The:

UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS

shall not apply.

41. VENUE

Where arbitration does not apply:

EXCLUSIVE VENUE

shall be located in:

LOS ANGELES COUNTY, CALIFORNIA.

You waive objections based upon:

  • improper venue;
  • inconvenient forum;
  • jurisdictional objections.

42. SURVIVAL

The following provisions survive termination indefinitely:

  • payment obligations;
  • intellectual property protections;
  • confidentiality obligations;
  • anti-piracy provisions;
  • indemnification;
  • arbitration;
  • waivers;
  • damages provisions;
  • liability limitations;
  • governing law;
  • venue;
  • competitive restrictions.

43. ASSIGNMENT

You may not assign or transfer rights under this Agreement without prior written consent.

RMG News Academy may assign rights in connection with:

  • merger;
  • acquisition;
  • restructuring;
  • sale of assets;
  • business transfer.

44. NO WAIVER

Failure to enforce any provision shall not constitute:

A WAIVER OF RIGHTS.

Any waiver must be:

IN WRITING.

45. SEVERABILITY

If any provision of this Agreement is determined unenforceable:

THE REMAINING PROVISIONS SHALL REMAIN IN FULL FORCE AND EFFECT.

46. RESERVATION OF RIGHTS

All rights not expressly granted are:

EXPRESSLY RESERVED.

47. NO AGENCY, EMPLOYMENT, OR PARTNERSHIP RELATIONSHIP

Nothing in the Services, this Agreement, or any communication between you and RMG News Academy creates any partnership, joint venture, employment, agency, fiduciary, contractor, franchise, representative, or other special relationship between you and RMG News Academy.

You are solely responsible for your own actions, business activities, journalism activities, legal compliance, expenses, equipment, taxes, insurance, and professional decisions.

48. ENTIRE AGREEMENT

These Terms of Service & User Agreement, together with any policies, disclosures, notices, and related legal documents of RMG News Academy, constitute the:

between you and:

d/b/a RMG News Academy

regarding the Services and supersede any prior or contemporaneous understandings, agreements, communications, negotiations, representations, or understandings, whether written or oral.

This Agreement shall be interpreted consistently with the following related policies and legal documents of RMG News Academy, including but not limited to:

  • Cookie Policy;
  • Accessibility Statement;
  • Refund & Billing Policy;
  • Licensing & Usage Terms;
  • DMCA / Copyright Policy;
  • AI Disclaimer & Acceptable Use Policy;
  • Disclaimer & Assumption of Risk;
  • Website Disclaimer & Legal Notice;
  • Media & Journalism Legal Notice;
  • Media Ethics Disclaimer;
  • Community Guidelines;
  • Earnings Disclaimer;
  • Affiliate Disclosure Policy.

These policies are:

INCORPORATED HEREIN BY REFERENCE

and collectively govern access to and use of the Services.

In the event of a direct conflict between these Terms and another policy:
