LEGALLY SAFE PUBLICATION.

10. COPYRIGHT, FAIR USE & LICENSING DISCLAIMER

  • privacy compliance;

  • business decisions.

You agree not to rely solely upon educational content when making:

LEGAL, SAFETY, OR HIGH-RISK DECISIONS.

Independent judgment and legal compliance remain your responsibility.

14. INDEMNIFICATION

You agree to:

DEFEND, INDEMNIFY, AND HOLD HARMLESS

  • contractors;
  • instructors;
  • affiliates;
  • licensors;
  • representatives;

  • investigations;
  • liabilities;
  • damages;
  • settlements;
  • penalties;
  • judgments;
  • attorneys[‘]{dir=”rtl”} fees;
  • costs

arising out of or relating to:

  • filming activities;
  • journalism activities;
  • publishing;
  • drone use;
  • scanner use;
  • copyright claims;
  • privacy claims;
  • defamation claims;
  • trespass claims;
  • responder interactions;
  • unlawful conduct;
  • unsafe conduct;
  • misuse of information obtained through the Services;
  • violation of law.

This obligation survives termination.

EXCEPT WHERE PROHIBITED BY APPLICABLE LAW.

15. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

RAISHBROOK MEDIA GROUP, LLC D/B/A RMG NEWS ACADEMY, ITS OWNERS, EMPLOYEES, CONTRACTORS, INSTRUCTORS, AFFILIATES, LICENSORS, CONTRIBUTORS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR:

  • legal claims;
  • arrests;
  • citations;
  • trespass claims;
  • publication disputes;
  • defamation claims;
  • copyright claims;
  • privacy disputes;
  • licensing failures;
  • monetization losses;
  • reputational harm;
  • business interruption;
  • lost profits;
  • lost income;
  • indirect damages;
  • incidental damages;
  • consequential damages;
  • punitive damages.

TO THE FULLEST EXTENT PERMITTED BY LAW:

OUR TOTAL AGGREGATE LIABILITY

shall not exceed:

THE TOTAL AMOUNT ACTUALLY PAID BY YOU

for the applicable Service giving rise to the claim during the preceding:

TWELVE (12) MONTHS.

16. INTERNATIONAL USERS

You acknowledge that laws relating to:

  • drones;
  • privacy;
  • copyright;
  • fair use;
  • scanners;
  • public recording;
  • publishing;
  • defamation;
  • trespass

vary substantially between jurisdictions.

You remain solely responsible for complying with laws applicable to your:

LOCATION, ACTIVITIES, AND PUBLICATIONS.

Nothing in this Notice limits:

NON-WAIVABLE LEGAL RIGHTS

where required by applicable law.

17. GOVERNING LAW

This Notice shall be governed exclusively by:

THE LAWS OF THE STATE OF CALIFORNIA

without regard to conflict-of-law principles.

Disputes relating to this Notice shall be governed by the:

including mandatory arbitration provisions.

18. SURVIVAL

The following provisions survive termination indefinitely:

  • legal disclaimers;
  • indemnification;
  • limitation of liability;
  • user responsibility;
  • governing law;
  • dispute resolution.

19. SEVERABILITY

If any provision of this Notice is determined unenforceable:

THE REMAINING PROVISIONS SHALL REMAIN IN FULL FORCE AND EFFECT.

20. ENTIRE AGREEMENT

This Notice shall be interpreted consistently with:

  • Disclaimer & Assumption of Risk;

  • Media Ethics Disclaimer;
  • Refund & Billing Policy;
  • Privacy Policy;
  • AI Disclaimer & Acceptable Use Policy.

In the event of a direct conflict between this Notice and the:

TERMS OF SERVICE & USER AGREEMENT

the Terms of Service shall control,

except where expressly stated otherwise or where prohibited by applicable law.
